Motor Vehicle Law

We provide the highest level of legal representation to motor vehicle lenders and new and used car dealers. Our firm has been involved in dealer-related issues in every legislative session since 1977. We were involved in writing much of the language in the Transportation Code relating to dealer licensing and bonding, and in the Tax Code relating to deferred sales tax on dealer financed used car sales. The firm offers a full range of legal services from licensing and compliance issues to litigation of complex disputes.

Our firm has helped clients establish and maintain consumer financial service programs. We focus on a wide array of issues that arise in connection with such programs, including documentation, consumer disclosures, and state licensing.

We have represented lenders and borrowers in establishing inventory finance programs. We have substantial experience in litigating priority-of-lien as well as usury issues associated with floor-plan finance programs.

We also assist our clients in compliance with state and federal disclosure rules. We monitor developments and changes in laws and regulations to ensure client compliance with applicable state and federal laws.

We have represented creditors in all levels of state and federal courts in defending consumer suits. Our working knowledge of substantive law in these areas saves our clients time and money in the defense in these types of cases.

The firm has handled hundreds of title dispute and security interest priority dispute cases. Appellate cases we have prevailed in stand as precedent in several areas of such disputes. Our long-term involvement in motor vehicle title legislation and litigation enables us to assist our clients without lengthy and time-consuming research.

For over 20 years we have represented wholesale auto auctions – from the smallest independents to the largest multi-national chains. We are familiar with the inner workings of auctions and are prepared to handle simple compliance issues as well as complex litigation.

Our firm represents buyers and sellers of portfolios of automobile installment paper. We have also assisted out-of-state finance companies in setting up programs in Texas. Many of our clients have sought our expertise in preparing portfolios for sale on private and public markets.

For 40 years we have provided legal assistance to buy here pay here dealers. Our clients have included family-owned, one-store operations and publicly-held companies. We have advised independent and franchised dealers in the establishment and operation of dealer-finance businesses.
